The Schedule I Reality

Cannabis remains a Schedule I controlled substance under the federal Controlled Substances Act. State legalization does not change federal law on federal property. The MRTA legalized cannabis at the New York state level — but New York State has no jurisdiction over federal parcels. Possession and consumption of cannabis on federal land in NYC is a federal violation, prosecuted (when prosecuted at all) in the U.S. District Court for the Southern District of New York or Eastern District of New York.

National Park Service Properties

The National Park Service manages an unusually large slice of NYC by federal-property standards:

  • Statue of Liberty National Monument & Ellis Island — in NY Harbor, accessed via Statue Cruises ferries from the Whitehall Terminal in Battery Park. Ferry boarding involves federal screening; do not bring cannabis.
  • Federal Hall National Memorial — 26 Wall Street, Manhattan. The site of George Washington’s 1789 inauguration; surrounded by federal courthouses.
  • African Burial Ground National Monument — Lower Manhattan. The largest known African burial ground in the U.S.
  • Stonewall National Monument — Christopher Park, Greenwich Village. Designated by President Obama in 2016. Cannabis on the monument grounds is federally illegal, even though the surrounding neighborhood is the heart of NYC’s cannabis-cultural history.
  • Governors Island National Monument — in NY Harbor. Ferry from Battery Maritime Building includes federal screening.
  • Gateway National Recreation Area — Floyd Bennett Field (Brooklyn), Jacob Riis Park (Queens), Jamaica Bay Wildlife Refuge (Queens), Sandy Hook (NJ). Spread across multiple boroughs and into NJ.

Federal Office Buildings

  • Federal Reserve Bank of New York — 33 Liberty Street, Manhattan. Most consequential central-banking institution in the world; substantial federal-employer footprint.
  • U.S. District Court for the Southern District of New York (SDNY) — Daniel Patrick Moynihan U.S. Courthouse (500 Pearl Street) and Thurgood Marshall U.S. Courthouse (40 Foley Square), Manhattan.
  • U.S. District Court for the Eastern District of New York (EDNY) — 225 Cadman Plaza East, Brooklyn.
  • U.S. Attorney’s Offices — SDNY (One St. Andrew’s Plaza) and EDNY (271-A Cadman Plaza East).
  • Federal post offices — the James A. Farley Post Office building and dozens of branch offices.
  • Federal Plaza (26 Federal Plaza) — ICE, FBI, USCIS, and other federal agencies in Lower Manhattan.
  • Jacob K. Javits Federal Building — 26 Federal Plaza area.
  • FBI Detroit… FBI New York Field Office — 26 Federal Plaza.
  • DEA New York Field Division — 99 10th Avenue, Chelsea.

Airports

JFK, LaGuardia, and Newark airports are federal jurisdiction within their secured areas. TSA is a federal agency and does not actively search for cannabis but typically refers small amounts to local law enforcement (the Port Authority Police Department generally takes no enforcement action below 3 oz at NYC airports). However, the moment a passenger boards a flight crossing state lines, they are committing a federal offense. Cruise Terminals

The Manhattan Cruise Terminal (West 55th Street), Brooklyn Cruise Terminal (Red Hook), and Cape Liberty Cruise Port (Bayonne, NJ) are subject to federal maritime jurisdiction under the U.S. Coast Guard and U.S. Customs and Border Protection. Cruise lines confiscate cannabis at boarding regardless of state legality and may bar passengers from boarding. Possession on a cruise ship is a federal offense.

What Happens If You’re Caught

Possession on federal land carries possible federal misdemeanor charges. In practice, federal prosecutors rarely pursue small-amount cases — but they can. More commonly, federal officers will confiscate cannabis without arrest and refer the matter to local law enforcement, where the case may be dropped entirely under MRTA, or pursued as a violation. Non-citizens face heightened risk: any cannabis-related federal action can have immigration consequences regardless of disposition.

Federal Workplace Considerations

Federal employees are subject to the Drug-Free Workplace Act of 1988 and Executive Order 12564, which mandate zero-tolerance drug policies regardless of state law. The NYC federal workforce includes Federal Reserve, U.S. Attorneys’ Offices, federal courts, FBI, DEA, ICE, CBP, IRS, and DHS staff — tens of thousands of New Yorkers.
